The Mastication Co. offers a convenient meal solution for their customers who are seeking optimal health and wellness outcomes, and who have been under the care of an accredited dietary Practitioner to reach these outcomes with an holistic approach. We offer personalised nutrition, with all meal plans created and executed specifically to the individual upon referral by their Practitioner. The Mastication Co. reserve the right to make any changes to the menus at our discretion. In addition, we reserve the right to refuse referrals from Practitioners and/or Client orders at our discretion.
Payment: The Mastication Co. accept Visa debit & credit cards, Master Card and Paypal. Charges will be applied in advance for the full value of the total order (i.e.; 7 day protocol = total value advertised). The order is only confirmed upon receipt of both an order confirmation with confirmed payment. The Mastication Co. reserve the right to amend or refuse the sale if payment is not received prior to delivery day. Please note that prices and delivery schedules may be affected due to compromised payment. The Mastication Co. reserve the right to change prices without prior notice. Credit card details will not be stored once payment has been successful.
Dietary protocol commitments: The Mastication Co. offers a unique dietary service for Practitioner referral to their clients. All referrals will require validation by the Practitioner via membership to The Mastication Co. website. Practitioner details will be utilised solely for this purpose and will not be shared with external entities per our Privacy Policy. The aim of The Mastication Co. is to ensure that the Practitioner is kept up to date with progression of dietary protocols per each referral and encouragement for ongoing monitoring at scheduled appointments within a Clinic environment. If, at any time, you feel this protocol is ineffective or can be improved, please contact The Mastication Co. by emailing themasticationco@gmail.com. Each delivery will be made with an easy to follow dietary schedule relative to meals, beverages, enhancements and supplements supplied, along with a blank diet diary to record the dietary experience, which can be shared in Practitioner/Client consultation. Regular informative text messages or emails from The Mastication Co. will be sent each morning to enhance the Client experience and set clear expectations. It is the responsibility of the Practitioner and the Client to ensure a list of all supplementation, medications and medical conditions is provided to The Mastication Co. at the time of referral and/or payment, to avoid contraindications.
Disclosure of Allergies, Aversions or Intolerances: Meals provided by The Mastication Co. are prepared and cooked in the same kitchen for all customers. We use a number of ingredients in our kitchen and while we do our best to ensure there is no cross-contamination, we cannot guarantee a total absence of any ingredient. Any concerns can be discussed by contacting The Mastication Co. via themasticationco@gmail.com. The Mastication Co. design personalised meal plans to target particular health outcomes for each individual client, therefore the use of milk, egg, gluten, seafood, peanuts, other nuts, sesame seed, capsicum and other allergens may be present at times in our kitchen. Responsibility to disclose all allergies, aversions, intolerances and health concerns via The Mastication Co. ordering process is mandatory, via the checkout process. It is also the Clients’ responsibility to refer to the Ingredients list of each meal prior to consumption and advise The Mastication Co. immediately if an error has been made. All care is taken to prepare nutrient dense meals specifically to unique requirements, however The Mastication Co. cannot guarantee a total absence of these products in any of our meals. The Mastication Co. strongly suggests consultation and maintenance with the referring Health Practitioner, prior and throughout your engagement of The Mastication Co. diet and lifestyle protocol(s). The Mastication Co. accept no liability or responsibility for adverse reactions to our meals.
Deliveries: If The Mastication Co. are to access secure parts of a home or building in order to deliver, notification is required at the time of placing the order. It is the Clients’ responsibility to keep The Mastication Co. up to date with any changes that might affect our ability to deliver. If we cannot access a building because of changes that we have not been notified of, we will attempt to make contact to make other arrangements. If we are unable to deliver in such circumstances, The Mastication Co. reserve the right to charge for unsuccessful delivery in any event. We will deliver The Mastication Co. meal plans as advertised per product description on our website. Time for delivery shall not be the essence of our contract. Due to circumstances beyond The Mastication Co. control, drivers / couriers may experience unavoidable delays. In these circumstances we respectfully request that The Mastication Co. are advised. We shall not be liable for any non-delivery, even if it is our fault, unless notified via email within 24 hours of the scheduled delivery time. Any liability for non-delivery within 24 hours shall be limited to replacing The Mastication Co. diet selection within a reasonable time or issuing a credit note. The Mastication Co. accepts no liability for the loss or deterioration of any goods once they have been delivered in accordance with the Customer delivery instructions and our terms and conditions. The Mastication Co. will not be held liable for any financial or physical damages of any kind. The Mastication Co. reserves the right to change or alter delivery days and cut off periods without notice.
Warranties and Liability: The Mastication Co. shall not be liable by reason of any misrepresentation (unless fraudulent) or any breach of warranty, condition or other term (express or implied) or any breach of duty or negligence for any damages whatsoever.
Use of the Website and our Publications: Unauthorised duplication or publication of any materials from our website is prohibited. Unauthorised duplication or publication of any other materials including but not limited to, brochures, text, graphics, recipes, newsletters, the selection and arrangement thereof, and all software compilations, underlying source code and software (our “publications”) is prohibited. As a use of the publications, you may retrieve and display content from the site on a computer screen and print out individual pages from the site on paper for the sole purpose of sharing a referral with your Client and/or placing an order with The Mastication Co. or using information from the Publications in the consumption of our products, but copying, modifying, or transmitting for any other purpose is strictly prohibited except with prior written permission from The Mastication Co. You may not commercially exploit any of the content of the Publications. You acknowledge that The Mastication Co. is our brand and that you may not use the name.
General Provisions: We shall not be liable for any delay or failure to perform any of our obligations under these terms and conditions due to any cause beyond our reasonable control, including industrial action. These terms and conditions constitute the entire agreement between you and us and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms and conditions express or implied by statute or otherwise, are excluded to the fullest extent permitted by law. The waiver by us of any breach or default of these conditions shall not be construed as a continued waiver of that breach, nor as a waiver of any subsequent breach of the same or any other provision. If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these conditions and the remainder of the provision in question shall not be affected.
Handling: Our products are packaged for refrigerated delivery. It is the Receivers’ responsibility to ensure frozen and chilled products should be put in freezers and refrigerators respectively, immediately upon receipt. Cooking and re-heating instructions must be followed closely. Make sure that re-heated food is piping hot throughout.
Theft: Theft or suspected theft of The Mastication Co. meal deliveries from the delivery address shall not be deemed as the fault of either the courier or The Mastication Co. We accept no liability for the loss or deterioration of any goods once they have been delivered and will not be held liable for any financial or physical damages of any kind. Please contact us immediately if there is reason to suspect that the delivery has been stolen from the delivery address supplied. If there is a risk that the theft will happen again, we may require alternative delivery arrangements for ongoing orders. In the meantime, we reserve the right to suspend deliveries until new arrangements have been finalised or to cancel the remaining deliveries, provided that we refund the fees for the cancelled period.
